The pay raise repeal legislation that the Supreme Court overturned last week was “non-severable”. In other words, if parts of the repeal legislation were found to be unconstitutional, the entire bill was to be ruled unconstitutional. The Pennsylvania Supreme Court ignored the constitution by “cherry picking” the parts of the legislation that they wanted to keep.

In the interest of full disclosure, I am a volunteer for Rep. Metcalfe. Rep. Metcalfe led the way on the discharge resolution to force a House vote on the pay raise repeal last year when Republican House leadership bottled it up in the Rules Committee.

It should be interesting to see who signs on with this legislation. It should also make for a good way to separate those who actually believe in enforcing the constitution, from those representatives that are simply towing the party line.
